OKLAHOMA CITY — Repeat sex offenders convicted of raping a child 6 years old or younger would be eligible for the death penalty under a bill passed by a House committee.

The bill by Rep. Rex Duncan was overwhelmingly approved Monday by the House Judiciary Committee, despite a 2008 U.S. Supreme Court ruling that such laws were unconstitutional.

The Sand Springs Republican says he feels the court erred in its decision and that he believes a new court could uphold the law.

In a Louisiana case in which a man was sentenced to death for raping an 8-year-old girl, the nation's highest court ruled that allowing the death penalty in such cases violates the Constitution's ban on cruel and unusual punishment.

Cruel and unusual punishment?  How about this?  IMMEDIATE death to anyone convicted of hurting a child.  The nearest tree and the nearest rope or the old fashioned horse whip or the child's father's six shooter.  There is too much consideration for the rights of people that don't live by other people's rights.

Couldn't agree more Wilma.  Child rape is the ultimate 'deal breaker' for me. Gone.............

If there is absolute certainty the event really happened and they have the right person, death for sure. Not all cultures take this as seriously as we do.

yep... no 2nd chances.. and I would not make their death an easy one either... I would give them 3 weeks in a cell with the baddest SOB in the joint.. let them get a real good feel for what that rape stuff feels like.. THEN I would take them out and...........well.... never mind.. I am getting way too much enjoyment out of me being the executioner.....

I wonder where the legislature came up with six years or younger?  So, it's okay for a repeat offender to rape some 7 years of age or older????  This law makes absolutely no sense to me.  And why does it have to be a repeat offender?  Why not just take care of the problem the first time around?
