The Obama administration will Monday unveil its long-anticipated updates to its guidelines on racial profiling, tightening limits on the practice but still allowing federal law enforcement agencies to employ it at airports and along the border.

The new rules replace guidelines created by the Bush administration in 2003, which banned racial profiling for federal law enforcement, but included broad exemptions for national security and border security. The Bush rules applied only to race, but the new policy also bans profiling on the basis of religion, national origin, sexual orientation and gender identification. [...]

"As attorney general, I have repeatedly made clear that profiling by law enforcement is not only wrong, it is profoundly misguided and ineffective — because it wastes precious resources and undermines the public trust," Holder said in a statement. "Particularly in light of certain recent incidents we've seen at the local level — and the widespread concerns about trust in the criminal justice process which so many have raised throughout the nation — it's imperative that we take every possible action to institute strong and sound policing practices."

Democrats Spent Big in Secret Effort to Elect Kansas
Independent Greg Orman


A month after the races ended, big-money super-PACs report their last-minute donors and spending.
 
It's been more than a month since the Nov. 4 election, but we're only just now finding out about some of the biggest campaign donations, including a previously undisclosed spending blitz by Democrats to try and elect Kansas independent Greg Orman.

Any political contributions to national party committees and super-PACs made on or after Oct. 16 didn't have to be disclosed until Thursday. The long delay between the late contributions and public disclosure creates an opportunity for mischief and a chance to move big money because super-PACs can raise funds in unlimited amounts to pay for ads independently supporting or attacking candidates.

Here's a look at how and where some of that late money moved:

Hidden Democrats:

Senate Majority PAC, a Democratic super-PAC run by former political advisers to Majority Leader Harry Reid, sent about $1.5 million to two super-PACs that promoted businessman Greg Orman, who was running as an independent and refused to identify with which party he would caucus. Orman was ultimately unsuccessful in his campaign to unseat Republican incumbent Pat Roberts.

Senate Majority PAC sent $1.31 million to Committee to Elect an Independent Senate in five installments beginning on (you guessed it) Oct. 16, the start of the veiled disclosure period. The Reid-aligned PAC also sent $151,000 on Nov. 3-4 to Kansans Support Problem Solvers, which also backed Orman.

Orman and Democratic groups kept each other at arm's length, at least publicly, in a state that has a generic Republican lean. Self-inflicted wounds by Roberts and his rusty campaign operation contributed to the senator's vulnerability. Roberts wound up winning by an unexpectedly large margin of 10 percentage points after overhauling his campaign team, sharpening his campaign message around opposition to President Barack Obama and Reid, and riding the Republican wave.

Committee to Elect an Independent Senate also received $1 million from Michael Bloomberg, the former New York City mayor who is the founder and majority owner of Bloomberg Politics parent company Bloomberg LP.

Democrats (Harry Reid) Spent Millions To Elect Trojan Horse Greg Orman

All of the suspicions people held about the true motives behind the failed Orman bid are essentially confirmed.

(MediaIte) In the 2014 midterms, independent candidate Greg Orman nearly unseated GOP incumbent Sen. Pat Roberts (R-KS), but eventually lost by a ten-point margin. This was sad for the Democrats — not just because it helped the GOP take over the Senate, but also because a Democrat-affiliated Super PAC had secretly poured $1.5 million into his race.

According to documents filed to the FEC and found by Bloomberg,, Senate Majority PAC, run by former advisors to Majority Leader Sen. Harry Reid (D-NV), quietly donated hundreds of thousands of dollars to two pro-Orman Super PACs after October 16th. This is important, because this magical time after this date is known as the "veiled disclosure period": Basically, people can donate millions of dollars to a PAC during this time, and legally, do not have disclose this transaction until after the election. (Technically, it's not secret money, but it kind of is.)


By keeping the transactions quiet, the Democrats avoided the perception that they were backing Orman, a self-financed candidate who ran as a political independent and refused to say which party he would caucus with.

'Worth Risking the Lives of Americans?'
Kelly, Napolitano Clash over Torture Report

The Senate Intelligence Committee is putting out a report tomorrow on the CIA usage of torture techniques under the Bush administration. There is some security concern over the report going public, which is why thousands of U.S. Marines all over the world have been put on alert and the CIA has bolstered security for people worried the report's release might make them a target.

And so tonight Fox News' Megyn Kelly asked the question: is it "worth risking the lives of these Americans?"

Judge Andrew Napolitano argues that yes, they should, because "the American people have a right to know what's been done in their name, especially when they're misled about it." He also said it's not the report that will endanger lives, it's what the report will reveal people did. Kelly said, "I'm sure that's gonna comfort the families of the dead analysts we're gonna see."

They went back and forth on the release of the report and committee chair Dianne Feinstein pushing for its release because she's upset the CIA snooped on her. Kelly said, "If she's ticked off that they spied on her, she needs to take it up with her therapist."

    President Obama — in his first televised interview since a Staten Island grand jury decided not to indict the New York cop who killed Eric Garner — said Monday that "bad training" and a "fear of folks who look different" in a small number of police departments across the U.S. have contributed to the ongoing mistrust between law enforcement and minority communities.

    "The vast majority of law enforcement officers are doing a really tough job, and most of them are doing it well and are trying to do the right thing," Obama said during a one-on-one interview with BET Networks that aired Monday. "But a combination of bad training, in some cases, a combination in some cases of departments that really are not trying to root out biases, or tolerate sloppy police work; a combination in some cases of folks just not knowing any better, and in a lot of cases, subconscious fear of folks who look different — all of this contributes to a national problem that's going to require a national solution."

    "This country is at its best when everybody is being treated fairly. We have a history and a legacy of people not being treated fairly in all kinds of walks of life," he said during the 30-minute special, titled "A Conversation with President Barack Obama." Harvard Law Students Demand Exam Delay Because Of
"Pain" Felt From Ferguson And Garner Grand Juries

    Columbia University Law School has granted exam extensions to students who feel under stress due to the failure of Grand Juries to indict in the deaths of Michael Brown and Eric Garner.

    Now students at my alma mater, Harvard Law School, are demanding similar treatment, as well as excoriating the HLS administration for not publicly feeling their pain.

    Dear Dean Minow and the Harvard Law School Administration:

    This campus ­­ and the nation ­­ erupted in outrage when grand juries failed to indict Officers Darren Wilson and Daniel Pantaleo for the killings of Michael Brown and Eric Garner, respectively. These recent events highlight that intolerance in America continues to cost us countless lives at the hands of law enforcement. We have no faith in our justice system, which systematically oppresses black and brown people. We are afraid for our lives and for the lives of our families. We are in pain. And we are tired.

    We have been visibly distressed and actively engaged throughout this public national crisis. The administration has remained silent.

    We led rallies, held vigils, and published an op­ed. You were silent on this issue. We petitioned the government, served as legal observers, created spaces of solidarity, drafted model legislation, and marched through the streets of Boston and Cambridge. You remained silent on this issue. We spent countless hours leveraging our legal educations, and utilizing our platform and privilege as students of this institution. And all we have heard from the administration is deafening silence.

    Your silence denies humanity to the lives lost and minimizes the gravity of the palpable anguish looming over campus. Like many across the country, we are traumatized. Just because this racial terror is systemically reproduced and normalized through repeated fidelity to the so ­called rule of law, it does not mean the disruption is any less traumatic than a tragic bombing. The fact that you refuse to openly acknowledge this adds to our distress. Your silence is a signal that Harvard Law School is indifferent to the welfare of many of its students.

    We can't breathe.

    Our choice to stand for justice rather than sit and prepare for exams is necessary in the context of a movement fighting for the lives that have been lost and continue to be at stake. This sacrifice is small. The words of Columbia Law School student leadership illustrate our sentiments: "In being asked to prepare for and take our exams in this moment, we are being asked to perform incredible acts of disassociation that have led us to question our place in this school community and the legal community at large." You cannot require that we forego joining the country in its demand for justice, and instead dedicate our energy in this moment to understanding and replicating "the same legal maneuvers and language on our exams . . . that w[ere] used to deny justice to so many Black and Brown bodies."

    Harvard Law School has policies and procedures in place for students experiencing a personal emergency that interferes with an exam or immediate pre-­exam preparation. This is more than a personal emergency. This is a national emergency.

In the past several days I have spoken with many students who have been struggling with the emotions brought on by the recent Grand Jury verdicts in Ferguson and Staten Island. This is a challenging moment for many who care deeply about justice and fairness.

Given the timing of these events, we understand that many of you are struggling with the challenge of focusing on academic obligations.

Mindful that we are in the exam period, we want to offer support including the following:

We are working with the Harvard Chaplains and local ministers to provide a space for reflection and support at HLS during the exam period.  Specific times and locations will be forthcoming.

On Tuesday, December 9th at noon in WCC3015, one of our Harvard Educational Specialists, Dorothy Bisbee, will lead a discussion on how best to concentrate on exams when you are experiencing strong emotions that interfere with your ability to focus.

For students who prefer confidential one-on-one support, we have a few options:

    The University's Counseling and Mental Health Services https://huhs.harvard.edu/HealthServices/CounselingAndMentalHealthServices.aspx provides support for students 24/7 for issues including stress, crisis management, and grief.
    The Harvard Chaplains http://chaplains.harvard.edu provide counseling and general support.  They help all students regardless of whether you wish to connect along a religious/spiritual affiliation or not (they do not prostletyze)

I also encourage you to come to our office to meet with Lakshmi Clark-McClendon (lclark@law) or me to discuss ways we can support your specific needs during the exam period.

As we try to process and make sense of these tragic events, it may help to think of the special role that we as lawyers can play to shape our system—to strive always to make that system and our society better and more just.  In an effort to begin the conversation, Dean Minow and Dean Post of Yale have expressed their views on the tragedies in Ferguson and Staten Island and on opportunities for legal reform in an op-ed piece forthcoming in the Boston Globe.

In the months ahead, there will be many opportunities at the Harvard Law School – and in the country at large – to examine our criminal justice system in light of the recent tragedies, to help gather and make sense of facts that will enhance understanding, and to think together about how to help bring about such change as we find necessary.  This is what we do.

Survey: Military Morale Plummets 35-Points Since Obuma Became Commander-In-Chief

A Military Times survey of 2,300 active-duty troops found morale indicators on the decline in nearly every aspect of military life. Troops report significantly lower overall job satisfaction, diminished respect for their superiors, and a declining interest in re-enlistment now compared to just five years ago.

Today's service members say they feel underpaid, under-equipped and under-appreciated, the survey data show. After 13 years of war, the all-volunteer military is entering an era fraught with uncertainty and a growing sense that the force has been left adrift.

One trend to emerge from the annual Military Times survey is "that the mission mattered more to the military than to the civilian," said Peter Feaver, a political science professor at Duke University who studies the military. "For the civilian world, it might have been easier to psychologically move on and say, 'Well, we are cutting our losses.' But the military feels very differently. Those losses have names and faces attached to [them]."

Acording to the Military Times survey, active-duty troops reported a stunning drop in how they rated their overall quality of life: Just 56 percent call it good or excellent, down from 91 percent in 2009. The survey, conducted in July and August, found that 73 percent of troops would recommend a military career to others, down from 85 percent in 2009. And troops reported a significant decline in their desire to re-enlist, with 63 percent citing an intention to do so, compared with 72 percent a few years ago.

Obama's Mental Illness Justifies His Removal from Office
Under the 25th Amendment

History has shown that most of the brutal dictators of the past have share two or three mental illnesses. These illnesses include Narcissistic Personality Disorder (NPD), Paranoid Personality Disorder (PPD) and Antisocial personality disorder (ASPD). Given the direction of the country, it is legitimate to ask whether or not this President is indeed mentally ill. In my professional opinion, any combination of two of these mental illnesses would prevent a President from discharging his duties as prescribed by the Constitution of the United States.


*The Twenty-Fifth Amendment-Section Four*

"Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President..."

If the President could be shown to mentally ill, under the 25th Amendment he could be removed from office. With the publicly available information, and based upon my training and experience in mental health diagnostics, I have conducted a mental health status exam of this President.


*The Mental Illnesses of Dictators*

Before analyzing President Obama according to these criteria, based upon observed public behaviors, please allow me to make a few general observations with regard to three conditions.  Narcissistic Personality Disorder
(NPD) sufferers believe that they are entitled to special privilege and that the rules of society apply to others but not to them. Paranoid Personality Disorder (PPD) individuals are people who are unusually suspicious in situations in which most people would not be concerned. They frequently change allies and lack stable relationships in their lives. Finally, Anti-Social Personality Disorder (ASPD) people are a combination of what we used to call a sociopath and a psychopath. These people are capable of doing great harm to another human being without feeling any empathy and remorse. This is the central element in the personality structure of a person who would commit genocide against their own people.

The remainder of this article explores if the current President is indeed mentally ill based upon the universally agreed upon diagnostic criteria as set forth by The Diagnostic and Statistical Manual (DSM).


*Narcissistic Personality Disorder*


In order for a person to be diagnosed with narcissistic personality disorder (NPD) they must meet five or more of the following symptoms:

■ Is preoccupied with fantasies of unlimited success, power, brilliance, beauty, or ideal love
■Believes that he or she is "special" and unique and can only be understood by, or should associate with, other special or high-status people (or institutions)
■Requires excessive admiration
■Has a very strong sense of entitlement, e.g., unreasonable expectations of especially favorable treatment or automatic compliance with his or her expectations
■Is exploitative of others, e.g., takes advantage of others to achieve his or her own ends
■Lacks empathy, e.g., is unwilling to recognize or identify with the feelings and needs of others
■Is often envious of others or believes that others are envious of him or her
■Regularly shows arrogant, haughty behaviors or attitudes


Five out eight of these symptoms are sufficient cause to warrant a positive diagnosis. Obama is one of the most self-righteous people on the planet and we have numerous quotes which exemplify this point. [/b] 

"We are five days away from fundamentally transforming America." Very few Americans had any idea what Obama meant by that quote. Six years into his presidency, it is clear that Obama meant to turn this country into an impoverished nation devoid of civil liberties. This is the ultimate expression of the communist legacy that he is trying to build.

This president does not tolerate normal criticism which comes with the territory of being a president. He has consistently sponsored legislation which inhibits the constitutionally guaranteed rights of legitimate protest with his support of the NDAA. This is the ultimate in haughtiness.

Obama exhibits extreme signs of feeling a sense of entitlement. His incessant misuse of the power of executive orders provides prima fascia evidence that "his will be done" and that he is above the law with regard to violating the constitutional rights of the American people.

Obama is an extremely exploitative person. However, in the grand scheme of politics, it is a needed survival skill to take advantage of people in one's climb to the top of the political world. Therefore, is Obama exploitative by nature, or, do the political realities of his position dictate the emergence of this trait as a survival skill? The jury is out on this one.

"You did not build that business." Remember that insulting and impersonal slap in the face of every small business owner in America? This statement is reflective of Obama's view that nobody is bigger than "my" government.

The President's statement in which he bragged he was really good at killing people by using drones speaks to his extreme level of insensitivity.

Of the eight traits associated with this disorder, I see seven of the eight with the eighth trait not being supported due to a lack of evidence.

President Obama clearly suffers from NPD. People with NPD can indeed function to some degree in society. However, they often make very ineffective leaders because they almost always put their needs ahead of the needs of the people they purport to serve.


*Paranoid Personality Disorder*

To make a positive diagnosis for this disorder, I would have to possess intimate details about the life of Obama. Unfortunately, that information is not readily available.

Here are the traits of PPD.

■Suspects, without sufficient basis, that others are exploiting, harming, or deceiving him or her
■Is preoccupied with unjustified doubts about the loyalty or trustworthiness of friends or associates
■Is reluctant to confide in others because of unwarranted fear that the information will be used maliciously against him or her
■Reads hidden demeaning or threatening meanings into benign remarks or events
■Persistently bears grudges (i.e., is unforgiving of insults, injuries, or slights)
■Perceives attacks on his or her character or reputation that are not apparent to others, and is quick to react angrily or to counterattack
■Has recurrent suspicions, without justification, regarding fidelity of spouse or sexual partner


Certainly, Obama's known childhood experiences could be explored as a baseline of this part of the examination; what childhood experiences? Exactly! Who is his high school basketball coach? Do his teachers remember him? Who in the world is he? When you couple this hidden childhood with that of living with Frank Marshall Davis, undoubted scarred him and left him with feelings of extreme abandonment. This factor, alone, could prove to be the breeding ground for PPD.

As I have previously covered, I know that most of his first-degree relatives were involved in MK Ultra. Certainly the breeding ground for PPD is in place given his unstable background.

Since we lack highly detailed information about his personal life, it is difficult to affirmatively diagnose Obama with this disorder, except for one thing. Since becoming president, Obama has fired nearly 260 command level officers from the military. In contrast, President Bush fired two. This would be the expected actions of a highly paranoid individual in that he would dismantle the command structure of military in such a significant manner. Although I cannot point to the fact that Obama has a requisite number of traits which determines that he is suffering from PPD, I think it is highly likely.
*Antisocial Personality Disorder*

Of all the mental illnesses we could examine with regard to a leader's propensity to commit extreme violence against his people, this would be the most concerning of all the mental illnesses. This disorder also happens to be where Obama has exhibited extreme pathological behavior with regard to this affliction.

The traits of ASPD are as follows:

■Failure to conform to social norms with respect to lawful behaviors as indicated by repeatedly performing acts that are grounds for arrest
■Deceitfulness, as indicated by repeated lying, use of aliases, or conning others for personal profit or pleasure
■Impulsivity or failure to plan ahead
■Irritability and aggressiveness, as indicated by repeated physical fights or assaults
■Reckless disregard for safety of self or others
■Consistent irresponsibility, as indicated by repeated failure to sustain consistent work behavior or honor financial obligations
■Lack of remorse, as indicated by being indifferent to or rationalizing having hurt an individual. They may display a glib, superficial charm and can be quite voluble and verbally facile (e.g., using technical terms or jargon that might impress someone who is unfamiliar with the topic). Lack of empathy, inflated self-appraisal, and superficial charm are features that have been commonly included in traditional conceptions of psychopathy and may be particularly distinguishing of Antisocial Personality Disorder in prison or forensic settings where criminal, delinquent, or aggressive acts are likely to be nonspecific. These individuals may also be irresponsible and exploitative in their sexual relationships (see the work of Jerome Corsi in this regard).


I wonder what Ambassador Stevens would say?

We know that this administration fired two senior command officers and prevented them from attempting to rescue Ambassador Stevens and his bodyguards, at Benghazi, while the attack was in progress. We also know that he and other senior level members of his administration watched by drone as the events unfolded and culminated in the deaths of Stevens and his team. As I have documented on this website, the evidence points to the fact that Stevens was the conduit which connected Obama to the arming of al-Qaeda in support of the Libyan and Syrian rebels.

Obama's use of drones to kill not only foreign nationals, but three American citizens, speaks to his depraved indifference to human life. The fact that he is continuing the war in Afghanistan, despite his campaign promises to the contrary, speaks to his absolutely reckless disregard for human life. People have been killed by drones as they attend weddings, babies die in their mother's arms, and children are maimed and killed by these machines and Obama brags that he is good at killing people with drones.

Obama has extreme superficial charm. After all, he twice fooled a nation of sheep with his manufactured demeanor. Obama is highly impulsive. His assistants do not know if he will attend an intelligence briefing or will he be on the golf course.

President Obama has never held a real job. He has served as a community agitator (err community activist), a state senator, a less than a one-term US Senator and then of course, a President. Where is his employment history? The bottom line is that this President has never held a regular job.

The President has engaged in repeated acts of lying and breaking the law as witnessed by the events at Benghazi, the NSA spy scandal, the IRS harassment scandal, Obama's spying on AP reporters, Fast and Furious gun running to the Mexican drug cartels, etc. This administration has been little more than one great big criminal enterprise.

President Obama's conduct in the handling of the Michael Brown crisis in Ferguson in which he clearly and intentionally exacerbated the crisis by dwelling on the "communities of color and their strained relationships with law enforcement". As true, or inaccurate as this statement was, it served to incite violence from those who were already upset.  Presidential speeches are measured and weighted for their psychological effect on the public. Obama knew exactly what he was doing.

The sum total of Obama's actions demonstrate a willful disregard for the welfare of others. ASPD individuals frequently use aliases. Do you think that "Barry," the student attending Occidental College, would ever do such a thing?

Of the seven traits listed above, one would have to claim the presence of four of the seven traits in order to justify a diagnosis of ASPD. I see six of seven traits being exhibited by President Obama. His superficial charm, his lack of remorse for his heinous acts and his inability to learn from his mistakes, unquestionably cast him in the role of being an ASPD individual.


Conclusion

Obama may or not be paranoid, although his treatment of the military would indicate that he is. Unquestionably, President Obama is suffering from NPD and ASPD. This is very concerning because a leader with NPD would not hesitate to put his needs ahead of the country that he is leading. This fact, combined with his definitive diagnosis, of an ASPD sufferer means that a person with the combination of these two traits would not hesitate to carry out acts of extreme violence against individuals and groups perceived as being a threat to the authority and position of President Obama.

We, indeed, have much to be concerned over and based upon the evidence, I would encourage the Cabinet to invoke Section Four of the Twenty-Fifth Amendment. This President is not capable of discharging his duties under the disabilities clause.

Is It Time To Invoke Section 4 of the 25th Amendment?

In the aftermath of the assassination of President John F. Kennedy, the U.S. Congress seriously took up the issue of Presidential succession and the process by which a sitting President could be removed from office, on the basis of incapacity to serve, due to physical or mental illness.

The U.S. Constitution was vague on the precise issue of succession and incapacity, and on several prior occasions, it led to potential crisis. In 1841, when President William Henry Harrison died in office, his Vice President, John Tyler, assumed the Presidency, even though the Constitution only provided for the Vice President to be "Acting President." When President Woodrow Wilson had a mental breakdown (widely attributed to a stroke) 18 months before his term expired, the First Lady and key White House advisors ran the country, without ever officially acknowledging that the President was incapacitated.

In 1963, Senators Estes Kefauver and Kenneth Keating proposed a Constititutional amendment, to authorize the Congress to legislate Presidential succession and rules for removing a President from office for incapacity. That effort was blocked out of fear that Congress could abuse the power. However, on Jan. 1, 1965, Senator Birch Bayh and Representative Emanuel Cellar introduced a Constitutional amendment, spelling out the procedures for succession and for determination of a President's incapacity. The amendment passed both Houses of Congress on July 6, 1965, and was sent to the states for ratification. On February 10, 1967, the required 38 states ratified the amendment.

The relevant section, dealing with Presidential incapacity, read as follows:

Section 4.
Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.

Thereafter, when the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that no inability exists, he shall resume the powers and duties of his office unless the Vice President and a majority of either the principal officers of the executive department or of such other body as Congress may by law provide, transmit within four days to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office. Thereupon Congress shall decide the issue, assembling within forty-eight hours for that purpose if not in session. If the Congress, within twenty-one days after receipt of the latter written declaration, or, if Congress is not in session, within twenty-one days after Congress is required to assemble, determines by two-thirds vote of both Houses that the President is unable to discharge the powers and duties of his office, the Vice President shall continue to discharge the same as Acting President; otherwise, the President shall resume the powers and duties of his office.

On two occasions, there was serious consideration of invoking Section 4: On March 30, 1981, when President Ronald Reagan was shot by would-be assassin John Hinckley, there was brief consideration of invoking Section 4, and an ad hoc group of close Presidential advisors, at Reagan's bedside, following his surgery, concluded that he was mentally fit to remain in office. In 1987, when Donald Regan was replaced by Howard Baker as President Reagan's Chief of Staff, Baker was urged to make a determination whether Reagan was still mentally sharp enough to serve out his term. After an initial White House meeting between the President and the new staff, Baker concluded that President Reagan was perfectly capable of continuing as President.
