A .440 life-time batting average would make one a hall-of-fame player if one was playing major league baseball. But Obamacare "aint' baseball and meeting only 44% of your own deadlines is pretty poor when one considers this is the Obama's signature legislation.



In a study never released to the public--according and published by Avik Roy in Forbes,  the non-partisan Congressional Research Service (CRS)  the Obama Administration had only completed 32 of 82 deadlines for implementing this intrusion into America's healthcare. Nine of those missed deadlines reported by the CRS were due to lack of congressional funding, so to be fair the President's record is 32 out of 73 or 44%. Twenty-three percent were completed late, and another third weren't completed by the time this report was released on June 5th.


Avik Roy:As of May 31, 2013, when the CRS analysis was completed, the White House had yet to meet 9 of 12 deadlines from the first year after the Affordable Care Act was enacted. It failed to meet 22 of 53 deadlines in the second year; another 8 became moot after Congress did not appropriate funds to complete the assigned tasks. In year three, the administration missed 10 out of 17 deadlines. That's a total of 41 out of 82 deadlines missed.
In analyzing the CRS report, I erred on the side of generosity. If the administration missed a particular statutory deadline by a week or less, I counted it in their favor as a "met" deadline. In any case where there was ambiguity in the CRS report, I assumed that the administration had met the deadline. So these 50-56 percent missed deadline figures should be seen as slightly conservative.

Most of the deadlines are for bureaucratic busywork

Most of these deadlines aren't for mission-critical features of the law, and the document reads like a kind of caricature of bureaucratic busywork. For example, Section 10407(d) mandates that by March 23, 2012, the Secretary of Health and Human Services is required to "submit to Congress a report on the appropriate level of diabetes medical education." To date, the report has not been located. Also on that date, the Secretary is required to "implement a 5-year national public education campaign on oral health care prevention and education." She missed that one too.


[Dirty] Harry Reid will tell you that the reasons for the missed deadlines is the GOP opposition to the bill, but that would only account for the nine deadlines missed due to lack of funding. The truth is, Obamacare is a monster, one so big that even its creators can't control it.

Even an administration with competent management skills would find it hard to implement this government takeover of our heath system. For the Obama Administration (and for the people) Obamacare is a disaster.

In the end the only way to control this monster is to "kill it." Despite what some pundits think, Obamacare will not kill itself, it will not collapse under its own weight. A bureaucracy is being built  to support it and as long as the Democrats own the Senate and the White House, the "monster" of Obamacare will continue to be fed, despite the errors and delays in implementation.

I'm not purposely trying to be dramatic. Almost daily I find examples of governmental abuse that would seem to indicate we are. Key to this is to remember that our Constitution, especially the Bill of Rights, lists the unalienable rights possessed by every man and bars the government from vi0lating them.

Today's examples are out of Texas where dashboard cams on police cruisers have recorded law enforcement officers searching the vaginal areas of women stopped for minor traffic offenses without a warrant or even a modicum of probable cause. The officers make a pretense of modesty and protection of rights by having a female officer do the search. As if that makes everything alright.


BRAZORIA COUNTY, Texas -- Two women subjected to body cavity searches on the side of Highway 288 have filed a Federal lawsuit against the officers involved.


It seems to me that the noose is drawing ever tighter and will continue to do so until we are choked into submission if we do not push back and demand our liberties not be so nakedly infringed (pun intended).

In Tennessee, and elsewhere, we have incredibly bad law which routinely violates the 4th Amendment rights of people to be secure in their persons, papers and possessions. We have laws which rewrite the definitions of words to make people criminals even though they are behaving responsibly. These sorts of things have to stop.


In Tennessee:
•Your blood can be forcibly taken from you to "prove" you are legally drunk just because an officer thinks you might be and wants the proof;

•You can be stopped and questioned and your vehicle searched in a DUI roadblock simply because you are driving on a particular stretch of road at the wrong time. Don't even think of trying to point out to the cops that they really do need more than "I'm passing by here" as probable cause;

•If you are being responsible and sleeping off a drunk in your car you can be arrested for DUI simply because you have your keys on you and might drive;

•You can be arrested for POSSESSION of a weapon while intoxicated if a weapon is simply in proximity to you. This is true if you are drunk in your car and the weapon is in your glove box. This is also true if you are drunk at home, with your weapons locked in a gun safe but you have access to the keys or combination. Proximity = Possession. No word on how it is unarmed citizens stopped for DUI escape this one when the armed officer approaches them ... ;

•The Granddaddy of them all, while not state or local law, is TSA. These federal employees are not even law enforcement and yet they can sexually assault you with impunity for your crime of wanting to complete a commercial transaction and take the plane flight you paid for.

The women involved in one of these searches sued the cops and the department settled with them. You can find a mash-up of the story with video here:


Frankly, there needs to be more push back by citizens to outrageous, illegal and unconstitutional behavior on the part of government and its agents. I understand that the purpose of government is to secure our rights. However, if we do not object when government is the very one violating our rights, we will wake up in a not too distant tomorrow to find we have no rights left.

Eternal vigilance, indeed, is what is needed to prevent the reality of a post-constitutional America.

Like all of the other collectivist schmucks, they can't point to their blueprint.  They have no blueprint, no final design they can show us.  They simply seek to have a few masterminds in some authoritarian, centralized government issue edicts.  They lust to control people, to tell them what kind of cars they can drive, what kind of health care they can buy, what kind of light bulbs they can have in their homes, how much energy they can consume, and virtually every other aspect of their lives.

They don't believe in individual liberty.  They don't believe in private property rights.  They don't believe in free markets.

And, most of all, they don't believe in the Constitution.

They despise the nation's highest law... the foundation of the greatest country ever seen on the face of the Earth.  They seek to eradicate the Constitution and replace it with a few master-planners who must use coercion to control every action of the citizen.

The very notion of God-given rights is anathema to kooks like this.  The government grants rights, don't ya know?  Like a "right" to health care, never mind if all of the doctors quit.  They'll force doctors to treat you!

These Statists have no model they can point to that has ever succeeded in all of human history.  For there is no such model.  Their path is the road to misery and despotism.

And we will resist them!

The statistics the Japanese government is handing out don't add up according to Jota Kanda,professor at Tokyo University of Marine Science and Technology.

" According to my research there are now 3 gigabecquerels [3 billion becquerels] of cesium-137 flowing into the port at Fukushima Daiichi every day. But for the 300 tons of groundwater to contain this much cesium-137, one liter of groundwater has to contain 10,000 becquerels of the radioactive isotope." says Kanda.

No one knows where 300 tons of melted nuclear fuel rods went, but is it responsible for contaminating the Pacific and a lot more? You have to find them before you can do anything about them. And even then, what do you do with them?

The barriers Tepco set up to contain them do not work. Decontamination of the cities around Fukushima has not worked either.

If they find the rods, they have no clue how to get them out and they will continue to radiate Japan and the Pacific ocean for a very long time.

Of course some believe they do know where the rods are: In the ocean, of course.
