According to Kansas Statutes Annotated...

17-5904   Restrictions; exceptions; penalties.

(a) No corporation, trust, limited liability company, limited partnership or corporate partnership, other than a family farm corporation, authorized farm corporation, limited liability agricultural company, family farm limited liability agricultural company, limited agricultural partnership, family trust, authorized trust or testamentary trust shall, either directly or indirectly, own, acquire or otherwise obtain or lease any agricultural land in this state...

(c)   Any corporation, trust, limited liability company, limited partnership or corporate partnership, other than a family farm corporation, authorized farm corporation, limited liability agricultural company, family farm limited liability agricultural company, limited agricultural partnership, family trust, authorized trust or testamentary trust, violating the provisions of this section shall be subject to a civil penalty of not more than $50,000 and shall divest itself of any land acquired in violation of this section within one year after judgment is entered in the action. The district courts of this state may prevent and restrain violations of this section through the issuance of an injunction. The attorney general or district or county attorney shall institute suits on behalf of the state to enforce the provisions of this section.


17-5902 Definitions. As used in this act:

(g)   "Agricultural land" means land suitable for use in farming.

(h)   "Farming" means the cultivation of land for the production of agricultural crops, the raising of poultry, the production of eggs, the production of milk, the production of fruit or other horticultural crops, grazing or the production of livestock. Farming does not include the production of timber, forest products, nursery products or sod, and farming does not include a contract to provide spraying, harvesting or other farm services.

(t)   "Limited liability company" has the meaning provided by K.S.A. 17-7663, and amendments thereto.
(u)   "Limited liability agricultural company" means a limited liability company founded for the purpose of farming and ownership of agricultural land...

By now you should know that corporations have a very tight grip on both parties, especially republicans, and will do whatever they please.  Are you really surprised that this isn't being enforced?  You continue to support corrupt politicians with your rhetoric and your vote and now you're surprised that your local government is corrupt?

Surprised?  No.  Disgusted?  Yes.

Since you don't know for whom I vote or have voted, your statement is absent some supporting facts.

Elk County government can't be corrupt!  Wilma, Mr Perkins, Charlie Durbin, catwoman, Diane and others here have said so.  So it must be true.  It's the rest of the world that's all screwed up.

In the most recent house election, the district in which you reside sent the only big business corporate sell-out in the race to congress,  you have elected one of the biggest all time corporate sell outs to be your state governor.  You're state legislators are no doubt just as bad.  These are the elected officials I was referring to, they are the people responsible for enforcing those statutes.

In the event the land is not classified/zoned as agricultural, then what?

Not being a zoned county, that part wouldn't seem to apply.  As to property tax classification, the statute clearly says ag land is that land suitable for agriculture... grazing, hay, crop production etc.  So you be the judge, does tax status change the spirit and intent of the statute?  I would say, based on suitable uses vs tax class for actual uses is a moot point.  So the question would be... is the owner a corp, partnership, LLC that is or is not registered with the state as organized as an Ag business?  The registry of the owner and suitability of the land is the determinate, not the taxed use.

You're making really good points, however if it's not a zoned county, the county appraiser's office has an assigned classification to property/tracts and I've seen rural land classified as something other than ag by the county appraiser in a non-zoned county.

For instance, perhaps a feed yard has something other than an ag classification. 

Suitable?  Is it suitable for ag if it's classified as something else?  Beats me....

Feedlot ops, swine production and other special operations are specifically addressed in the statute as being decided by public vote, I believe.
