I have an 1862 Police. Five shot. The question is can this piece be loaded with five and the hammer placed in the safety notch?

The answer is YES.  Safety rules call for the hammer to be placed down on an empty chamber, or BETWEEN chambers.  If there is a safety notch in the cylinder or safety pins to prevent the cylinder rolling inadvertently and placing a loaded round under the hammer.  Just placing the hammer with an integral firing pin between cartridge rims does NOT meet the criteria.
